A Senate proposal touted as protecting Americans' e-mail privacy has been quietly rewritten, giving government agencies more surveillance power than they possess under current law, CNET has learned.

Patrick Leahy, the influential Democratic chairman of the Senate Judiciary Committee, has dramatically reshaped his legislation in response to law enforcement concerns, according to three individuals who have been negotiating with Leahy's staff over the changes. A vote on his bill, which now authorizes warrantless access to Americans' e-mail, is scheduled for next week.
Leahy's rewritten bill would allow more than 22 agencies -- including the Securities and Exchange Commission and the Federal Communications Commission -- to access Americans' e-mail, Google Docs files, Facebook wall posts, and Twitter direct messages without a search warrant. It also would give the FBI and Homeland Security more authority, in some circumstances, to gain full access to Internet accounts without notifying either the owner or a judge.

CNET obtained a draft of the proposed amendments from one of the people involved in the negotiations with Leahy; it's embedded at the end of this post. The document describes the changes as "Amendments intended to be proposed by Mr. Leahy."

It's an abrupt departure from Leahy's earlier approach, which required police to obtain a search warrant backed by probable cause before they could read the contents of e-mail or other communications. The Vermont Democrat boasted last year that his bill "provides enhanced privacy protections for American consumers by... requiring that the government obtain a search warrant."

Leahy had planned a vote on an earlier version of his bill, designed to update a pair of 1980s-vintage surveillance laws, in late September. But after law enforcement groups including the National District Attorneys' Association and the National Sheriffs' Association organizations objected to the legislation and asked him to "reconsider acting" on it, Leahy pushed back the vote and reworked the bill as a package of amendments to be offered next Thursday. The package (PDF) is a substitute for H.R. 2471, which the House of Representatives already has approved.

One person participating in Capitol Hill meetings on this topic told CNET that Justice Department officials have expressed their displeasure about Leahy's original bill. The department is on record as opposing any such requirement: James Baker, the associate deputy attorney general, has publicly warned that requiring a warrant to obtain stored e-mail could have an "adverse impact" on criminal investigations.

Christopher Calabrese, legislative counsel for the American Civil Liberties Union, said requiring warrantless access to Americans' data "undercuts" the purpose of Leahy's original proposal. "We believe a warrant is the appropriate standard for any contents," he said.

An aide to the Senate Judiciary committee told CNET that because discussions with interested parties are ongoing, it would be premature to comment on the legislation.

Marc Rotenberg, head of the Electronic Privacy Information Center, said that in light of the revelations about how former CIA director David Petraeus' e-mail was perused by the FBI, "even the Department of Justice should concede that there's a need for more judicial oversight," not less.

Markham Erickson, a lawyer in Washington, D.C. who has followed the topic closely and said he was speaking for himself and not his corporate clients, expressed concerns about the alphabet soup of federal agencies that would be granted more power:

There is no good legal reason why federal regulatory agencies such as the NLRB, OSHA, SEC or FTC need to access customer information service providers with a mere subpoena. If those agencies feel they do not have the tools to do their jobs adequately, they should work with the appropriate authorizing committees to explore solutions. The Senate Judiciary committee is really not in a position to adequately make those determinations.

The list of agencies that would receive civil subpoena authority for the contents of electronic communications also includes the Federal Reserve, the Federal Trade Commission, the Federal Maritime Commission, the Postal Regulatory Commission, the National Labor Relations Board, and the Mine Enforcement Safety and Health Review Commission.

Leahy's modified bill retains some pro-privacy components, such as requiring police to secure a warrant in many cases. But the dramatic shift, especially the regulatory agency loophole and exemption for emergency account access, likely means it will be near-impossible for tech companies to support in its new form.

A bitter setback
This is a bitter setback for Internet companies and a liberal-conservative-libertarian coalition, which had hoped to convince Congress to update the 1986 Electronic Communications Privacy Act to protect documents stored in the cloud. Leahy glued those changes onto an unrelated privacy-related bill supported by Netflix.

At the moment, Internet users enjoy more privacy rights if they store data on their hard drives or under their mattresses, a legal hiccup that the companies fear could slow the shift to cloud-based services unless the law is changed to be more privacy-protective.

Members of the so-called Digital Due Process coalition include Apple, Amazon.com, Americans for Tax Reform, AT&T, the Center for Democracy and Technology, eBay, Google, Facebook, IBM, Intel, Microsoft, TechFreedom, and Twitter. (CNET was the first to report on the coalition's creation.)

Leahy, a former prosecutor, has a mixed record on privacy. He criticized the FBI's efforts to require Internet providers to build in backdoors for law enforcement access, and introduced a bill in the 1990s protecting Americans' right to use whatever encryption products they wanted.

But he also authored the 1994 Communications Assistance for Law Enforcement Act, which is now looming over Web companies, as well as the reviled Protect IP Act. An article in The New Republic concluded Leahy's work on the Patriot Act "appears to have made the bill less protective of civil liberties." Leahy had introduced significant portions of the Patriot Act under the name Enhancement of Privacy and Public Safety in Cyberspace Act (PDF) a year earlier.

One obvious option for the Digital Due Process coalition is the simplest: if Leahy's committee proves to be an insurmountable roadblock in the Senate, try the courts instead.

Judges already have been wrestling with how to apply the Fourth Amendment to an always-on, always-connected society. Earlier this year, the U.S. Supreme Court ruled that police needed a search warrant for GPS tracking of vehicles. Some courts have ruled that warrantless tracking of Americans' cell phones, another coalition concern, is unconstitutional.

The FBI and other law enforcement agencies already must obtain warrants for e-mail in Kentucky, Michigan, Ohio, and Tennessee, thanks to a ruling by the 6th Circuit Court of Appeals in 2010.

I've noticed that you have taken the t-shirts and stickers off your websites store, in order to get people to buy your "premium" account.
I thought I'd share with you, why I will not be getting a "premium" account.

1. I would never pay money, for a website that rejects videos without an appeal.

The last video I tried to upload was a screen shot of a video chat; the two women in that screen shot were over 40 (one had streaks of gray in her hair). There were no logos identifying what site/service I was communicating to these women on; thus no copyright problems. Despite taking into account issues of age and copyright, the video was still rejected.

2.I would never pay for a website that changes the rules on whats allowed all the time without notice.

There appears to be a new, unwritten policy forbidding faces on chat videos. The video before my last video was a screen shot of me jerking off to a woman's boobs and it was approved; the last video I uploaded (mentioned above) was not. So the rules changed and none of us were notified? Some videos 3 years old, are removed for "new rules". As an uploader, I can't work this way.

3. I would never pay for a website, if the admins are rude.

Anyone who tries to ask a question, or god forbid, a reason as to why their video is removed is meet with cartoonish immaturity.
Look I've worked in customer service for years. If you insult the customer, you lose the customer. You may think uploaders are a dime a dozen; but they make your website. Without us, you have no content; and if you keep screwing the uploaders your site will suck.
Taking away the t-shirts and stickers doesn't bother me; however trying to pressure me into buying a service, instead of pulling up your sox and running it properly does (Your insulting your customers again...bad business move).

4. I would never pay for an adult site, that uses the threat of lawsuits as an excuse.

Your in the adult entertainment industry; so YES you have lawsuits. I've worked in all forms of the entertainment industry (including the adult industry) both as a performer, retail, customer service and distributing; anything with the word "adult" in it will get you lawsuits. I've dealt with lawsuits, zoning and licencing problems working in adult entertainment; fighting them is part of the business.
If you can't fight them all just close down this website and make another one; but don't use getting sued as an excuse, its part of porn.

All this being said I'm not saying I would NEVER get a "premium" account, just not one right now. You have the ability to do a better job, and I hope you will.
The first site to do so was anyoneup.com, they didn't take stuff down because of an empty threat of a lawsuit, they stood up to Facebook and the FBI; and look at the money and mainstream success anyoneup.com had.

You have to ask yourself if you want to be number 1, or yesterday.

I know all posts made on this message board need to meet your approval; and the chances of you allowing such honest and frank criticism as this post, is about the same as getting a response.
It did give me something to do for the last 5 mins of my lunch break.

I confess that I just hate these god-damn niggers running around. A few days ago I had to go to the bank to cash a check. It was a sizable amount so had to go inside instead of the drive-thru. I went in and stood in the long ling waiting for a teller while looking around. I haven't been in there since last month and the place looked like shit! The nice furniture they had before was replaced by some mauve upholstery and the nice shiny stone floor was replaced by this ugly tan carpeting!

When the line moved up, I got closer to the tellers. Three were humans and one was a big fat sheboon with corn rows and a gold front tooth. I thought it was a male at first but two saggy mountains were attached to its chest! I silently prayed that I would get one of the humans, 3/4 odds isn't bad odds. Finally, the lady in front of me was called up by a man and the nigger was the only one open. It hollered "Next?! C'mon up he-re Mista!". I pretended like I didn't notice since I wanted to wait for a human but they were busy with customers.

The idiot behind me tapped me on my shoulder and said "That lady on the left is open, sir." Then I just decided to go up to the sheboon as I was too considerate of others to hold up a line like a nigger would. I went up to the sheboon and presented my check to it.

"Is this real?" it asked me with an odd ball glance. I nodded silently but was thinking "of course it is you stupid ass nigger!" Then the sheboon typed into the computer and had me give my ID. I been a customer of this bank for 12 years and this was the first nigger who serviced me. I had given it a form so it would deposit most and I wanted two thousand eighty in cash. I was given a receipt that showed the money was now in my account.

The nigger started counting out the cash I was owed and when finished, gave me it. I counted it to myself because I didn't trust this nigger and sure enough I was about two hundred short! I axed the sheboon that it made a mistake and I needed two hundred more. "But Is counted it, mista!" it yelled out. I said "No, when I counted there was two hundred missing. Can I see the manager!" The nigger snarled and yelled back "You musta hid it in yours pocket! I counted the change right!"

All the commotion had alerted a security guard who came over and demanded to know what the problem was. I told him that this sheboon took $200 from me. She screamed that she counted it fairly and that I was hiding it. The manager finally came over from hearing the loud fuss the sheboon was making and asked what was going on. I filled him in while the sow began squealing that she counted it right. I gave him the money and he counted it. Sho nuff, there was $200 short. He told the sheboon so but she yelled "He musta hided it!" I said that the sheboon saw me count the money right in front of her and I had no time to hide anything. I said they could even look at the surveillance camera if they wanted.

After I brought up the camera, miraculously the sheboon put $200 on the counter saying it fell on the floor while she was counting. I didn't buy it at all because niggers are criminals. I don't know how this one got a job at the bank unless AA or a liberal was responsible. The manager apologized to me and gave me a free tote bag that they give out to those who open new accounts. I didn't accept and told him that I wanted to close my account. This one niggerfuxated experience was enough for me!

I then left the bank and got into my car. I then called a friend to tell him of what happened. Twenty minutes or so later, I started to pull out of the parking lot but then as I'm driving away I see that sheboon with two security guards outside the building! I think it got fired or arrested..or both . I won't be going to that bank again. If they are stupid enough to hire one nigger then more and more will come in eventually. My friend recommended his bank that doesn't have any nigger tellers at all and that's where I opened a new account that very day.

Anybody else ever have coon-tact with niggers, and it just ruins your day?

I confess that AT&T Uverse is the shittiest excuse for a cable/internet provider. It's too damn expensive, the equipment is absolute shit, and the "customer service" is non-existent.

If I am recording a show in HD, I can only watch that show. If I try to watch something else it pauses, skips, and is unwatchable. The best part, the show I try to record pauses and skips then too.

The wireless Internet is a great concept, except it uses the same resources as the cable. So when watch a show in HD, I can't stay connected to the Internet for more than a few seconds at a time.
